Question:
A person passed away on 13th January 2019 before Thuhr. When will the Iddat of his wife complete?
Answer:
In principle, the Iddah of a deceased’s wife is 4 months and 10 days. If her husband passes away on the 1st of any month of the lunar calendar, the Iddah will be exactly 4 months and 10 days regardless of whether the months consist of 29 or 30 days. However, if her husband passes away on any other date other than the 1st of the month, the Iddah will be for 130 days considering each month to be 30 days. In the enquired scenario, the Marhoom passed away on the 13th of January 2019 which corresponded to the 6th of Jumad-ul-Ulaa 1440. Therefore, the Iddah will end exactly after 130 days from the time the Husband passed away. Hence, the deceased’s wife’s Iddah will end on the 23rd of May 2019 before Zohr (the time the husband passed away). If the wife was pregnant when her husband passed on then her Iddah will end as soon when she gives birth. (Ahsanul Fataawa Vol. 5 Pg. 449)
