Stool going directly into bag without any control

Question: 

My brother has a stomach illness called chrones disease where his bowels are inflamed, they tried different medicines but his condition was just getting worse so eventually the conducted an operation and took out his big bowel and replaced it with a stoma bag attached to his stomach now his excretion (number 2) goes directly into his bag without his controll, also when he passes wind (gas) it goes directly into his bag, sometimes he can hear it and sometImes he cannot, he empties the bag around 4 times a day and changes the bag to a new one every night, when he goes to the toilet to urinate nothing comes out from the back passage except mucus and discharge sometimes, so I wanted to ask in regards to his taharat and wudhu, how often does he need to do wudhu to pray Salah and read quran etc? 


Answer: 

If there is no control over one’s bowels as in this case such that excretion, gas etc. are on constant flow at any given time such that one does not find enough time to perform ablution and complete his salah in a clean condition then such a person will be regarded as ma’zoor.i The rulings with regards to such a person are as follows: 

1. A Ma’zoor must make a fresh wudhu for every Fardh Salah time. 

2. The wudhu performed will be sufficient for all other Nafl prayers, reading Quran etc. during that Salah time. 

3. The wudhu will expire with the expiry of each Salah time and a fresh wudhu will need to be performed for the next Salah time. 

4. Any reason which normally breaks wudhu will still break the wudhu, for example bleeding (only the cause of becoming Ma’zoor will be excused which in this case is the flow of excreta into the bag.) 

NOTE; It will not be valid for a Ma’zoor, to perform Ishraaq Salah with the wudhu of Fajr as the expiry of a Salah time terminates the wudhu of a Ma’zoor person and the expiry of the time of Fajr is with sunrise. A fresh wudhu must be performed for Ishraaq Salah. Similarly, he should perform wudhu for Maghrib Salah only when the Maghrib time sets in, i.e. upon sunset. A Ma’zoor cannot make wudhu for Maghrib Salah before sunset.

i)وصاحب عذر من به سلس( بول لا يمكنه إمساكه )أو استطلاق بطن أو انفلات ريح أو استحاضة( أو بعينه رمد أو عمش أو غرب، وكذا كل ما يخرج بوجع ولو من أذن وثدي وسرة )إن استوعب عذره تمام وقت صلاة مفروضة( بأن لا يجد في جميع وقتها زمنا يتوضأ ويصلي فيه خاليا عن الحدث )ولو حكما( لأن الانقطاع اليسير ملحق بالعدم )وهذا شرط( العذر )في حق الابتداء، وفي( حق )البقاء كفى وجوده في جزء من الوقت( ولو مرة )وفي( حق الزوال يشترط )استيعاب الانقطاع( تمام الوقت )حقيقة( لأنه الانقطاع الكامل..... )وحكمه الوضوء( لا غسل ثوبه..... ونحوه )لكل فرض( اللام للوقت كما في }لدلوك الشمس{ ]الإسراء: - 78 [ )ثم يصلي( به )فيه فرضا ونفلا( - فدخل الواجب بالأولى )فإذا خرج الوقت بطل( أي: ظهر حدثه السابق، حتى لو توضأ على الانقطاع ودام إلى خروجه لم يبطل بالخروج ما لم يطرأ حدث آخر أو يسيل كمسألة مسح خفه. )الدر المختار و حاشية ابن عابدين مطلب في احكام المعذور ١ / ٣٠٥ )
