Question: 

If a person is doing Qurbani overseas (country A), and that particular country's Eid is a day before, will that person's Qurbani be valid as country A will slaughter the animal before the person performs Eid salaah? 

Answer: 

There is a difference of opinion amongst the scholars in regards to the validity of the Qurbani of a person upon whom Qurbani hasn’t yet become Waajib due to the days of Qurbani not having yet dawned upon him, even though the days may have dawned upon the people living in the area where his Qurbani will be carried out.

Some scholars are of the opinion that the Qurbani in country ‘A’ is valid since the place of slaughtering is taken into consideration.

However, our Darul Ifta does not concur with the above view. We are of the view that Qurbani will only be valid when the days of Qurbani dawn upon a person, thus making it Waajib upon him to carry out the act of Qurbani during those days. So if Eid is on Friday in country “A” but it is on Saturday in country “B”, Eid has not yet dawned upon the residents of country “B”; implying that Qurbani has not yet become Waajib upon them on Friday. So Qurbani cannot be carried out prior to it becoming Waajib. Keeping this view in mind, the Qurbani will only be valid if carried out in country “A” on Saturday and not on Friday.
