Selling one's vehicle at a car stand

Question: 

I wanted to know is it permissible, if i take my car and park it at ceratin car stand, so how they work is that they take a starndered commission on every car sale. So you give them a price to mark the vehicle. So if they get inquiry for sale of the car they phone you and ask is it ok for them to sell, the price they give you includes there commission. You have the authority to accept or decline, if the car does not sell in a while, you allowed to take the car off with no payment due to them. Please advise what other options is allowed?


Answer: 

In the queried scenario we understand that the owner of the vehicle leaves his car at the stand with the intention of having it sold. The owner dictates and fixes the price of the vehicle and he is also aware of the stipulated percentage that will be levied by the car dealer for selling the vehicle. For example, the stipulated selling price of the vehicle is fixed at R100 000.00 and the dealer charges 10% commission which is R10 000.00, hence the commission amount is fixed and known. This option is in order in terms of Shari’ah. This would be the best option that comes to our mind.
